On September 4th, the EHRC submitted their updated Code of Practice (which exclusively encourages trans people to be excluded from single sex services and spaces) to the UK Government’s Minister for Equality. It’s up to the Minister whether she approves the Code, or sends it back to the EHRC and asks them to make changes.
As of the time of writing, the Minister still hasn’t yet approved it or sent it back. Now is a crucial time to put the pressure on and help the Minister understand what a devastating impact this Code would have on trans people’s lives.
TransActual and Trans+ Solidarity Alliance have developed a template email that you can send to your MP, encouraging them to tell the Minister to reject the exclusionary Code and demand that any new version ensures providers can lawfully include trans people in their services.

The template gives you an idea of what you can say, but the more personal you make it, the more effective it is likely to be.
From May 20th to June 31st 2025, the Equality and Human Rights Commission (EHRC) hosted a consultation on draft changes to their Code of Practice in light of the Supreme Court ruling on the meaning of “sex” in the Equality Act (new tab). The EHRC have used AI to consider the 50,000 consultation responses, potentially changes to the draft Code, and submitted it to the UK Minister for Equalities for approval in just 2 months. However, as the EHRC is still yet to publish the updated version of the code or their analysis of the responses, and as the draft Code was focused almost exclusively on how trans people can be excluded and segregated from services and spaces, we don’t expect any positive changes to be made to provide clarity on how we can be included.
